29 CFR 1926.251(d)(6)(v): Natural and synthetic fiber rope slings were not removed from service when abnormal wear such as discoloration or rotting was present: (a) Multi-Purpose Building (under construction), 3456 W Casa Blanca Rd., Casa Blanca, AZ 85221: On or about 28 February 2013, and at times prior thereto, the employer, as the General Contractor and Controlling Employer on site, did not ensure that synthetic fiber rope slings, in plain view, were not removed from service by the sub-contractor when abnormal wear such as discoloration was present, exposing the employees to hazards.

29 CFR 1926.251(d)(7): Natural and synthetic-fiber rope slings did not have permanently affixed and legible identification markings that stated the rated capacity, type of fiber material, and the number of legs if more than one: (a) Multi-Purpose Building, 3456 W Casa Blanca Rd., Casa Blanca, AZ 85221: On or about 28 February 2013, and at times prior thereto, the employer, as the General Contractor and Controlling Employer, did not ensure that synthetic fiber rope and synthetic webbing slings owned by, in plain view and available for hoisting use by a sub-contractor, had indentification markings which were permanent and legible as to the rated capacity, type of fiber material, and number of legs if more than one.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval: (a) 3456 W Casa Blanca Rd., Casa Blanca, AZ 85221: On or about 28 February 2013, the Employer, as the General Contractor and Controlling employer, did not ensure that a SKYTRAK Telescopic Reach Forklift, owned by a sub-contractor had the manufacturer's written approval to drill holes into the fork tines, which were in plain view, before allowing the forklift to operate on the project it controlled, exposing the employees to hazards.
