29 CFR 1926.652(g)(2): Excavations of earthen material to a level greater than 2 feet (.61m) below the bottom of a shield was permitted: (a) W.E. ONeil Construction Co. at 1130 S. Lincoln St, Denver, CO 80210: On March 17, 2014 the controlling employer did not ensure that subcontractor employees working inside a shield system on the north end of a trench were protected from cave-in. The depth of the trench was approximately 10 feet. Sections of soil ranging from 4 feet to 2.7 feet were exposed from the bottom of the shield system to the bottom of the trench. This condition exposed subcontractor employees to a crushing hazard by trench wall cave-in. (b) W.E. ONeil Construction Co. at 1130 S. Lincoln St, Denver, CO 80210: On March 17, 2014 the controlling employer did not ensure that employees working inside a shield system on the south end of a trench were protected from cave-in. The depth of the trench was approximately 10 feet. Sections of soil ranging from 4 feet to 2.7 feet were exposed from the bottom of the shield system to the bottom of the trench. This condition exposed subcontractor employees to a crushing hazard by trench wall cave-in.
