29 CFR 1910.95(c)(1): 29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8-hour time-weighted average (TWA) sound level of 85 dBA: (a) Production area- An employee operating the Northtech planer/sander and the CNC machine was exposed to continuous noise at 113.2 % of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 90.9 dBA during the 468 minute sampling period on April 25, 2013. (b) Production area- An employee operating the ripsaw and the panel saw was exposed to continuous noise at 100.3 % of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 90.0 dBA during the 466 minute sampling period on April 25, 2013.

29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employees or whenever respirators are required by the employer, the employer did not establish and implement a written respiratory protection program with required worksite-specific procedures: (a) Spray painting area- The employer had not established or implemented an adequate respiratory protection program for an employee required to wear a half mask air purifying respirator while spray painting wooden countertops. There was no written program, proper respirator storage or training. The respirator was stored hanging on the wall inside the spray painting area.
