On or about February 25, 2013, and at times prior thereto, employees engaged in masonry activities and working on a welded frame scaffold which did not rest on mud sills were exposed to falls of more than 8 feet to the ground and/or concrete below.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used. End frames were used as a means of access. On or about February 25, 2013, and at times prior thereto, employees engaged in masonry activities and working on welded frame scaffolds were not provided safe access to all upper levels. Employees were exposed to falls of more than 8 feet to the concrete below.

29 CFR 1926.451(e)(8): Direct access to or from another surface was not used when the scaffold was more than 14 inches (36 cm) horizontally and/or 24 inches (61 cm) vertically from the other surface. On or about February 25, 2013, and at times prior thereto, employees engaged in masonry activites and working from welded frame scaffolds were not provided with safe access from the scaffold to the structure. Employees were exposed to falls of more than 11 feet to the concrete below.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about February 25, 2013, and at times prior thereto, an employee was exposed to a fall of more than 11 feet to the concrete below when he accessed a structure from the welded frame scaffold platform. No fall protection was provided. Galindo & Boyd Wall Systems was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 397624, citation number 1, item number 1 and was affirmed as a final order on June 20, 2012, with respect to a workplace located at 8333 Preston Road, Frisco, Texas 75034.
