29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    Noise monitoring was not conducted for the employees with the following exposures:    a) Pallet Assembly Area - A nailer/pallet assembler was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (Permissible Level). The employees dosimeter dBA level was 305% of the permissible level (90 dBA) and was equivalent to approximately 98.1 dBA. The sampling was performed for 436 minutes during one shift on 3/14/13. Zero exposure was assumed for the unsampled period of time.     b) Pallet Dismantling Saw Area - A saw operator was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (Permissible Level). The employees dosimeter dBA level was 249% of the permissible level (90 dBA) and was equivalent to approximately 96.6 dBA. The sampling was performed for 462 minutes during one shift on 3/14/13. Zero exposure was assumed for the unsampled period of time.     c) Pallet Assembly Area - A nailer/pallet assembler was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (Permissible Level). The employees dosimeter dBA level was 149.5% of the permissible level (90 dBA) and was equivalent to approximately 92.9 dBA. The sampling was performed for 442 minutes during one shift on 3/14/13. Zero exposure was assumed for the unsampled period of time.     d) Pallet Assembly Area - A nailer/pallet assembler was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (Action Level). The employees dosimeter dBA level was 124.0 % of the permissible level (90 dBA) and was equivalent to approximately 91.6 dBA. The sampling was performed for 431 minutes during one shift on 3/14/13. Zero exposure was assumed for the unsampled period of time.     e) Cut Off Saw Area - A saw operator was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (Action Level). The employees dosimeter dBA level was 67.8 % of the permissible level (90 dBA) and was equivalent to approximately 87.2 dBA. The sampling was performed for 454 minutes during one shift on 3/14/13. Zero exposure was assumed for the unsampled period of time.
