29 CFR  1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  a) Production area - The employer did not establish a lockout tagout program consisting of energy control procedures, employee training and annual inspections for employees who performed job tasks such as, but not limited to changing the blades on the pallet dismantling saws,  conveyor circular saw and mitre saw.  On or about 1/30/2024  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a)Production area  and yard - Employees who operated the facility's five Toyota propane forklifts (Model 8FGU25/Serial Number 96394;  Model 8FGU25/Serial Number 97935; Model 8FGU25/Serial Number 42166; Model 8FGU25/Serial Number 37142 and Model 7FGU30/Serial Number 66520) were not trained on those vehicles as required by the standard, on or about 1/30/2024.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

29 CFR  1910.212(a)(3)(ii):Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):  a) Rear of production area:   The point of operation blade of the interior pallet dismantling saw (horizontal band saw) used by employees to cut metal pallet nails was not guarded. On or about 1/30/2024.  b) Rear yard of facility:  The point of operation on the blade of the exterior pallet dismantling saw (horizontal band saw) used by employees to cut metal pallet nails was not guarded. On or about 1/30/2024.  c) Production Area: The unused portion of the blade on the pallet trim saw used by employees to cut wood pallet slats to size was not guarded. On or about 1/30/24.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
