29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: On or about On or about March 1, 2013, at an excavation site, daily inspections of an open trench were not conducted prior to employees entering the trench to conduct work, exposing the employees to the hazard of being crushed by the soil.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). On or about March 1, 2013, at an excavation site, no protective devices, effective benching or sloping were in place to protect employees as they worked in a trench with unprotected vertical walls, exposing the employee to the hazard of being crushed by collapsing soil.
