OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while working from an elevated work platform: Employees were exposed to to fall hazards while working from a work platform on the forks of a forklift where the platform was not secured to the lifting carriage or forks, there was no means to center the platform laterally, and employees were using the mast of the forklift as an anchorage point for their personal fall arrest system which is not an approved anchorage point.
