29 CFR 1926.451(g)(1)(vii):     For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.          a)     On or about March 05, 2013, at the worksite, the employer did not ensure that employees were adequately protected while working from a pump jack scaffold, at heights greater than 10 feet, thereby exposing employees to an approximate 25 foot fall hazard.

29 CFR 1926.454(c)(3):     When the employer has reason to believe that an employee lacks the skill or understanding needed for safe work involving the erection, use or dismantling of scaffolds, the employer shall retrain each such employee so that the requisite proficiency is regained. Retraining is required in at least the following situations:   Where inadequacies in an affected employee's work involving scaffolds indicate that the employee has not retained the requisite proficiency.  [61 FR 46025, Aug. 30, 1996]          a)     On or about March 05, 2013, the employer did not ensure that employees performing siding/trim work, were clear on the requirements for adequately guarding pump jack scaffolds, when used at heights greater than 10 feet.

29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.          a)     On or about March 05, 2013, at the worksite, the employer did not ensure that employees that were working from the balcony area, performing siding/trim work, were provided and used fall protection while working at heights greater than six feet, thereby exposing employees to an approximate 25 foot fall hazard.

29 CFR 1926.503(c)(3):     "Retraining." When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee. Circumstances where retraining is required include, but are not limited to, situations where:  Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.          a)     On the site, the employer did not ensure that employees performing siding/trim work, were clear on the requirements of recognizing hazards such as, but not limited to falls, when working from an unguarded balcony area at heights greater than six feet.
