Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:   An employee was exposed to a fall from an elevated hydraulic excavator bucket while working from a excavation located at intersection of Woestboul Street & Casten, East Saint Louis, IL, when the employees was elevated in the bucket of a Caterpillar 328d Excavator for the purpose of accessing and egressing the employee from a 12 foot deep excavation     Abatement Note: Among others, one feasible means of abatement would be to use a ladder to access and egress from the excavation and to follow "The American Equipment Manufactures Safety manual for hydraulic excavators which states "Never use a bucket for a work platform or personnel carrier."

The employer did not instruct employees to control and eliminate the hazards present at the jobsite in accordance with the OSHA regulations.

29 CFR 1926.651(k)(1):   An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  Two employees working in a 10 foot 8 inch deep excavation were not provided a ladder or other safe means to access and egress from the trench, and were not provided cave-in protection.  The employer did not have a competent person inspect the excavation prior to the start of the work to control and eliminate the hazards present at the jobsite in accordance with the OSHA regulations.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal):             An employee was working in an approximately 30 foot long by 18 foot wide and 10 foot 8 inch deep excavation which the north wall of the excavation was approximately sloped  at 80 degrees which was greater than the required 45 degrees and the exposed employees were not protected by an adequate protective system.
