29 CFR 1910.134(c):     The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use:    a) The employer failed to develop and implement a written Respiratory Protection Program which shall include medical evaluations, training and fit testing for employees within the Power Coating and Spray Painting Departments who were required to wear 1/2 face tight fitting respirators such as but not limited to 3M 6000 series respirators.      There is no abatement certification or documentation required for this item.

The employer failed to provide training to employees who operated a sit down Mitsubishi forklift used to  transport skids/boxes and heavy parts within the warehouse.         Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel.     a). On or about March 7, 2013 the employer failed to remove from service a sit down Mitsubishi forklift, which caused four employees to be transported to the emergency room for potentially being exposed to carbon monoxide.       There is no abatement certification or documentation required for this item.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.   a). On or about March 6, 2013 the employer failed to conduct daily inspections to a nonsafe operating sit down Mitsubishi forklift in which caused four employees to be transported to the emergency room for potential exposure to carbon monoxide. 29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:      a) A written Hazard Communication Program that includes training, and an inventory list of chemicals had not been developed by the employer to educate employees on the physical and health hazards presented by chemical within the workplace such as but not limited to Cleaner 925 (corrosive), Phos Coat 455A (corrosive) including spray and powder coating paints.      Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
