29 CFR 1926.1053(b)(22): An employee carried object or load that caused the employee to lose balance and fall: a) 14 Bedford Street, Dewey Beach, DE (Indian Beach) - Employees carried and installed joist and posts on a 3rd floor deck while working on 6' Werner fiberglass step ladders. An employee attempted to make adjustments and lost his balance while holding up the joist/post. He fell off the ladder and the deck, approximately 20-25 feet, to the ground below. The violation was observed on or about March 6, 2013.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) 14 Bedford Street, Dewey Beach, DE (Indian Beach): Employees working on the 3rd level deck of a residential construction site, approximately 20-25 feet above the ground, with unprotected sides or edges. The employees were exposed to fall hazards from working on the unguarded areas. An employee was working on a ladder to install joists and posts when he fell off the ladder and deck to the ground below. The violation was observed on or about March 6, 2013.
