29 CFR 1926.28(a):     The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees.     (a) Construction Site- On or about March 4, 2013 an employee was operating a Caterpillar TL642 Telehandler Forklift (serial no. HR 3178) without wearing seatbelt on uneven muddy ground.

29 CFR 1926.100(a):     Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.     (a)  Scaffolds, Right-side of Building - On or about March 4, 2013 an employee was exposed to being struck by falling cinder blocks while other employees were working directly above him. Employees were not wearing hardhats.     (b)  Scaffold facing Highland Colony Parkway - On or about March 4, 2013 an employee was exposed to being struck by wood boards when a scaffold with loose wood boards was moved. Employee was not wearing a hardhat to prevent head injuries.

29 CFR 1926.451(g)(1):     Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.   Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.     (a)  Scaffold, Right-side of Building (left-side) - On or about March 4, 2013 an employee was exposed to a fall hazard while standing on a scaffold 13.9 feet above ground with no guardrail system or personal fall areest system.     (b) Scaffold, Right-side of Building (center) - On or about March 4, 2013 an employee was exposed to a fall hazard while standing on a scaffold 20.9 feet above ground with no guardrail system or personal fall arrest system.      (c) Scaffold, Right-side of Building (right-side) - On or about March 4, 2013 an employee was exposed to a fall hazard while standing on a scaffold 13.9 feet above ground with no guardrail system or personal fall arrest system.

29 CFR 1926.454(b): The employer shall have each employee who is involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question. The training shall include the following topics, as applicable:     (a)  Construction Site - On or about March 4, 2013 employees were not provided training on how to recognize, eliminate and prevent exposure to fall hazards when working on scaffolds.

29 CFR 1926.451(e)(1):     When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.    (a)    Scaffold, Riight-side of Building (left-side) - On or about March 4, 2013 an employee was exposed to a fall hazard while climbing on a welded metal frame scaffold without an access ladder. Employees climbed the frame of the scaffold. The scaffold was 20.6 feet above the ground.      (b)   Scaffold, Right-side of Building (center) - On or about March 4, 2013 an employee was exposed to a fall hazard while climbing on a welded metal frame scaffold without an access ladder. Employees climbed the frame of the scaffold. The scaffold was 20.9 feet above the ground.      (c)    Scaffold, Right-side of Building (right-side) - On or about March 4, 2013 an employee was exposed to a fall hazard while climbing on a welded metal frame scaffold without an access ladder. Employee climbed the frame of the scaffold. The scaffold was 13.9 feet above the ground.          The BR Brick was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(e)(1), which was contained in OSHA inspection number 313023665, citation number 01, item number 003 and was affirmed as a final order on July 14, 2009, with respect to a workplace located at 6130 Johnston Street, Lafayette, LA 70503.
