29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) On or about March 7, 2013, Taylor Morrison, as a controlling employer, failed to ensure that employees of McClure Concrete, Inc. (subcontractor) were protected from cave-in hazards while they worked next to an approximately 11 feet deep wall of an excavation which was not adequately sloped or benched and did not have any other cave-in protection in place.
