29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: (a) At the site of the excavation, located near the south entry of 3810 Law Street, on or about March 14, 2013 - Daily inspections were not made by a competent person. The designated comepetent person was not competent in that he was unable to identify and correct hazardous conditions exposing employees to engulfment hazards when protection systems were not used to eliminate said hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) or (ii): (a) At the construction site, located near the south entry of 3810 Law Street in Houston, Texas, on or about March 14, 2013 - Employees for Rago Enterprises were exposed to engulfment hazards while performing work from inside an excavation which was not equipped with a protective system, benching, or sloping.
