29 CFR 1926.651(k)(2):     Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.    a) Long Beach Blvd & 76th St., Long Beach Twsp.:  Two employees were exposed to caught-in and crushing hazards while working in an unshored trench greater than 6 feet deep with nearly vertical side walls.  The excavation showed visible fissures and showed evidence of small scale cave-ins.  The employees were not protected from cave-ins by adequate protective systems, shoring, sloping or benching.  The employers competent person did not remove the employees from the hazardous trench.  Observed on or about 3/15/13.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

Nor had the employer complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical.      a) Long Beach Blvd & 76th St., Long Beach Twsp.:  Two employees were exposed to caught-in and crushing hazards while working in an unshored trench greater than 6 feet deep with nearly vertical side walls.  The employees were not protected from cave-ins by adequate protective systems, shoring, sloping or benching.  Observed on or about 3/15/13.     P & A Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 315640987, citation number 01, item number 02, and was affirmed as a final order on 02/21/2012.         NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
