OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential fire and explosion from explosive dust: a) Solid Surface Production Area - On and prior to March 29, 2013, there was a potential for hybrid mixtures of Category 2 flammable liquids (lacquer thinner and denatured alcohol) and explosive solid surface dust (St1) due to the use of solvent soaked cloths used without localized ventilation. Nearby ignition sources include static and electrical components. Air is recycled back into the room from the air material separators. Hybrid mixtures can be flammable even when the vapor concentration is less than the lower flammable limit and the dust is below the minimum explosible concentration. b) Solid Surface and Wood Production Area - On or around March 29, 2013, air material separators were located indoors near employee work areas presenting fire and explosion hazards. Air material separators included but were not limited to, Dust Technology Model DT-75 Serial 9810607 CFM 3450, Dust Technology Model DT-200 Serial 23081509 CFM 7500, and 8 Overhead Denray Machine Model 3000 OH CFM 3000. c) Wood Production Area - On or around March 29, 2013, air was recycled back into the work environment from air material separators with a cleaning efficiency of 98% allowing for particulate to be suspended in air. Nearby ignition sources include static and electrical components. Air material separators included but were not limited to, Dust Technology Model DT-75 Serial 9810607 CFM 3450 and Dust Technology Model DT-200 Serial 23081509 CFM 7500. d) Wood Production Area - On or around March 29, 2013, the employer did not follow the manufacturer filter replacement schedule recommendations for air material separators including but not limited to, Dust Technology Model DT-75 Serial 9810607 CFM 3450 and Dust Technology Model DT-200 Serial 23081509 CFM 7500. Dust Technology recommends filter change after one year. The employer has never changed the filters which have been in operation for approximately 7 years. This can lead to reduced suction, increased dust in the ducts, and increased ambient particulate.

29 CFR 1910.106(e)(9)(iii): Combustible waste material and residues in a building or unit operating area were not kept to a minimum, stored in covered metal receptacles and disposed of daily: a) Solid Surface Production Area - On and prior to March 29, 2013, cleaning rags soaked in Category 2 Flammable Liquids including but not limited to lacquers thinner and denatured alcohols, are laid out to vent to the atmosphere prior to throwing in the general trash bin. The trash bin was an open headed plastic drum. The environment also contains explosive dust and there is a potential for a dangerous hybrid mixture.
