29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  The employer did not ensure that employees working in residential construction working 6 feet or more above a lower level was protected by a  fall protection system.This violation was observed on or about 12-february 2013 at the construction site where employees were exposed to an approximate 34 foot fall hazard when performing roofing work without a fall protection system.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities are protected from falling when exposed to falls 6 feet or more above a lower level.

29 CFR 1926.1053(b)(1): Where ladder was used to access the upper landing surfaces, the ladder side rails did not extend at least 3 (9 m) feet above the upper landing surface to which the ladder was used to gain access.   The employer does not ensure that a ladder used by employees is extended 3 feet above the upper landing surface. This violation was observed on or about February 12, 2013 at the construction site where employees were exposed to an approximate 14 foot fall hazard when using a ladder that its side rails did not extend to at least 3 feet above the upper landing surface to which the ladder was used to gain access.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that ladders used by employees have the ladders side rails extended at least three feet above the upper landing surface and secured its top to a rigid support.
