29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). The employer does not protect employees from falling when working 6 feet or more above lower levels. This violation was observed at the construction site on or about July 16, 2013 where employees were exposed to fall of 10 ft. when performing roofing work without fall protection. JORGE GONZALES WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(b)(13) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 897342, CITATION NUMBER 01, ITEM 001 AND WAS AFFIRMED AS A FINAL ORDER ON MAY 07, 2013, WITH RESPECT TO A WORKPLACE LOCATED AT 2619 ALAN LAKE LANE, SPRING, TX 77388. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities 6 feet or more above lower levels are protected from falling.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access. The employer does not ensure that the ladder used by employee has it's side rails extended 3 feet above the upper landing surface. This violation was observed at the construction site on or about July 16, 2013 where employees were exposed to fall of 10 ft. when using a ladder without the ladder's side rails extended 3 feet above the upper landing.
