29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about 3/25/13 at residential roofing construction site 196 Linwood Ave., Buffalo, NY: Employees engaged in roofing work were exposed to a potential fall of approx. 22 ft. from the south side of the roof. Employees were not trained to recognize potential hazards on this type of jobsite including falls from roofs, ladders, scaffolds, & electrical hazards as well as the regulations applicable to controlling or eliminating these hazards. ABATEMENT CERTIFICATION REQUIRED

No guardrail system, safety net system, or personal fall arrest system was utilized. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders' length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) On or about 3/25/13 at residential roofing construction site 196 Linwood Ave., Buffalo, NY: Employees were exposed to a fall of approx. 22 ft. when an extension ladder was used to access the roof from the ground. The siderails of the ladder only extended approx. 13 inches above the roof. NO ABATEMENT CERTIFICATION REQUIRED
