29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace: a) The Right Power House - The employer did not quantitatively evaluate the atmosphere for oxygen deficiency and carbon monoxide concentrations prior to requiring employees to enter the facility, nor did the employer require the use of air supplied respirators or self-contained breathing apparatus: 1. Right Power House on March 9, 2013, where the employer did not require the use of respiratory protection as employees performed tasks such as, but not limited to, assessment of fire damage and development of sampling strategies. 2. Right Power House on March 9, 2013, where the employer required employees to wear North 7700 half-face negative pressure respirators during tasks such as, but not limited to, collection of wipe samples and placement of air monitoring pumps. 3. March 10, 2013, Office Tower - The employer did not quantitatively evaluate the atmosphere for oxygen deficiency and carbon monoxide concentrations prior to requiring employees to enter the Office Tower. The employer evaluated and selected proper personal protective equipment for employee's exposure to particulate and asbestos fiber hazards. The employees were performing housekeeping tasks such as, but not limited to, vacuuming and washing surfaces. NOTE: The evaluation shall include a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form. Where the employer cannot identify or reasonably estimate the employee exposure, the employer shall consider the atmosphere to be IDLH.
