29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. The employer does not protect employees from falling when working 6 feet or more above a lower level.This violation was observed on or about March 26, 2013, on the roof of a single family house where employees were exposed to a 16 and a 20 foot fall hazard when performing roofing work without a fall protection system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities are protected from falling when exposed to falls 6 feet or more above a lower level.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: The employer does not ensure that a portable ladder used by employees is extended 3 feet above the upper landing surface. This violation was observed on or about March 26, 2013 at the construction site where employees were exposed to a fall hazard when accessing a roof, when the ladder did not extend at least 3 feet above the upper landing. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that ladders used by employees have the ladders side rails extend at least three feet above the upper landing surface.
