29 CFR 1910.23(a)(2): Ladderway floor opening(s) or platform(s) were not guarded by a standard railing with standard toeboard(s) on all exposed sides (except at the entrance to opening) with passage through the railing either provided with a swinging gate or so offset that a person could not walk directly into the opening: On or about April 2, 2013, the employer failed to ensure that the platform openings for the fixed ladders were provided with a swinging gate: (a) Near the Cleaver-Brooks boiler 1, employees were exposed to fall hazards of approximately 10 feet in that the ladderway openings were not guarded. (b) Near the Cleaver-Brooks boiler 2, employees were exposed to fall hazards of approximately 10 feet in that the ladderway openings were not guarded. (c) Near the Cleaver-Brooks boiler 3, employees were exposed to fall hazards of approximately 10 feet in that the ladderway openings were not guarded.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent): On or about April 2, 2013, the employer failed to ensure open-sided floors and/or platforms four feet or more above the adjacent floor or ground level were guarded with standard railings or equivalent: (a) Near the Cleaver-Brooks boiler 1, employees used a platform during routine maintenance and cleaning of the boiler and were not protected from fall hazards of approximately 10 feet. (b) Near the Cleaver-Brooks boiler 2, employees used a platform during routine maintenance and cleaning of the boiler and were not protected from fall hazards of approximately 10 feet. (c) Near the Cleaver-Brooks boiler 3, employees used a platform during routine maintenance and cleaning of the boiler and were not protected from fall hazards of approximately 10 feet.

(b) Near the Cleaver-Brooks boiler 2, there was not at least 4 inches of clearance between the centerline of the fixed ladder's grab bar and the guard rail post on the boiler platform. (c) Near the Cleaver-Brooks boiler 3, there was not at least 4 inches of clearance between the centerline of the fixed ladder's grab bar and the guard rail post on the boiler platform.
