Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards.      On or about 03/26/2013 at the Wilmington, NC Marine Terminal, a means of fall protection was not provided to employees exposed to a fall of approximately 12 feet while placing plastic tarps over the top of intermodal shipping containers staged at the marine terminal for fumigation.    Among other methods of abatement, one feasible and acceptable method to correct this hazard is to prohibit employees from conducting work from the top of intermodal container without the use of a fall protection system.  Work positioning or fall restraint system that will allow the worker to approach a fall hazard and work, but will not allow the worker to fall to a lower level.      Royal Pest Solutions was previously cited for a violation of this occupational safety and health standard or its equivalent standard Section 5(a)(1), which was contained in OSHA inspection 476618, citation 1, item number 001 and was affirmed as a final order on September 17, 2012, with respect to a workplace located at P.O. Box 932, Wilmington, NC 28402.
