OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. a). On and time times prior to 2 April 2013, a Terex Crane boom truck (model: BT-3470 KIT, serial# 0703BT3470564 with a Johnson Block hook was being operated with a broken self-closing spring latch and a missing latch pin that prevents material from incidentally becoming detached from the hook under slack conditions, exposing employees to struck-by hazards from falling material. At the time of the inspection, the crane was used to lift material out of the bed of a pick-up truck in the above conditions.

29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. a). On or about 2 April 2013, an employee not wearing a protective helmet was standing in the bed of a Ford F-650 dump truck (Georgia License Plate # AII 3856) while other employees on the roof threw removed roll roofing and fiber board insulation material onto a blue tarp that slid into the bed of the dump truck, exposing the employee to overhead struck-by hazards.
