29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: At this establishment the Nissan and Mitsubishi forklift trucks had unsafe conditions such as, but not limited to: a. No functional back-up alarms. b. Worn out tires. Magic Valley Fresh Frozen, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.178(q)(1) which was contained in OSHA inspection number 458333, citation number 01, item number 004 and was affirmed as a final order on November 19, 2012, with respect to a workplace located at 3701 W. Military Highway, McAllen, Texas.
