29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:    a)  Employees were not provided with a safe means of egress when working in a trench with a depth of approximately 7.5 feet.    The Di Meo Brothers, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 313064800, citation number 2, item number 1 and was affirmed as a final order on May 12, 2009, with respect to a workplace located at Main St. and Fairview Ave. Park Ridge, IL.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c):      The employer does not protect each employee in its excavations by properly sloping the excavation or by using appropriate protective systems designed in accordance with paragraphs (b) or (c) of 29 CFR 1926.652.      a) This most recently occurred on April 3, 2013, at corner of E. Devon Ave. and S. Prospect Ave., Park Ridge, Illinois.  Employees are exposed to cave-in hazards while installing a catch basin in an excavation that was approximately 7.4 feet in depth.      To abate this hazard in the future, the employer must ensure that its excavations are properly sloped, or that protective systems designed in accordance with this standard are used, and that no employees enter the excavations until protection is provided.       The Di Meo Brothers, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 315298901, citation number 1, item number 1 and was affirmed as a final order on August 2, 2011, with respect to a workplace located at Mary Kay Ln. and Pebbleford Ln. Glenview, IL.    The Di Meo Brothers, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 313064800, citation number 1, item number 1 and was affirmed as a final order on May 12, 2009, with respect to a workplace located at Main St. and Fairview Ave. Park Ridge, IL.    Pursuant to 29 CFR 1903.19, The employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from excavation cave-ins.

29 CFR 1926.652(g)(2):  Excavations of earth material to a level greater than 2 feet (.61m) below the bottom of a shield was permitted:      a) On or about May 3, 2013, the employer permitted earth to be excavated approximately 2.8 feet below the bottom of the trench box and allowed its employees to work within it.    The Di Meo Brothers, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(g)(2), which was contained in OSHA inspection number 314257395, citation number 1, item number 1 and was affirmed as a final order on February 15, 2011, with respect to a workplace located at Dempster St. between Meade Ave. and Fernald Ave. Morton Grove, IL.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
