29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:   (a) Pallet Area -  On or about March 19, 2013 the pallet builder was exposed to noise at a level of 89.0 dBA for a period of 380 minutes.  A hearing conservation program had not been implemented including the annual audiometric testing.  A zero increment was used for the period of time not sampled.   (b) Pallet Area - On or about March 19, 2013 the saw operator was exposed to noise at a level of 91.6 dBA for a period of 380 minutes.  A hearing conservation program had not been implemented including the annual audiometric testing.  A zero increment was used for the period of time not sampled.   (c) Pallet Area - On or about March 19, 2013 the pallet builder was exposed to noise at a level of 92 dBA for a period of 380 minutes.  A hearing conservation program had not been implemented including the annual audiometric testing.  A zero increment was used for the period of time not sampled.
