Section (5)(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to drowning and/or crushed-by hazards:  At a Grand Isle Marina facility, located at 1 Grand Isle Drive, Grand Haven, MI, employees were exposed to a drowning hazard from a barge capsizing or sinking due the fact a dredge (barge and equipment) was in use without regard for the capacity or load limit.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:   On or about April 2, 2013,  employees were exposed to the hazards related to struck by, pinch, crush and caught hazards due to the fact a pintle hook fork attachment was being used with an Allis Chalmers forklift, model number ACP80PS SNGL, serial number ABK1303445 without the manufacturers written approval. the pintle hook attachment was used to pull 40 foot boats weighing up to 35,000 pounds.

On or about April 3, 2013, the employer failed to post the 2012 annual summary of work-related injuries and illnesses.   A recordable injury occurred in January 20, 2012 when an employee cut 5th right finger when his hand slipped caught a sharp edge of a steel clamp.  Employee was seen by occupational health physician and received 4 sutures and was authorized to return to work without restrictions.

29 CFR 1915.152(b): Hazard assessment and equipment. The employer shall assess its work activity to determine whether there are hazards present, or likely to be present, which necessitate the employee's use of PPE. If such hazards are present, or likely to be present, the employer shall:   On or about April 3, 2013, employees were exposed to hazardous chemicals, flying debris, falls from elevation hazards, point of operation hazards and a written work place hazard assessment had not been completed.  A written workplace hazard assessment is used to determine what hazards are present, or likely to be present, which require the use of Personal Protective Equipment (PPE), and is documented through a written certification.    The employer shall:  (1) Select the type of PPE that will protect the affected employee from the hazards identified in the hazard assessment;  (2) Communicate selection decisions to affected employees;  (3) Select PPE that properly fits each affected employee; and  (4) Verify that the required occupational hazard assessment has been performed through a document that contains the following information: occupation, the date(s) of the hazard assessment, and the name of the person performing the hazard assessment.
