29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) At Lot 50 Woodley Circle Auburn, Alabama: On or about April 2, 2013 and at times prior; the employer exposed his employees to fall hazards of 11.5 feet to the floor below in that he allowed employees to use a ladder that was not extended at least three feet above the landing area.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) At Lot 50 Woodley Circle Auburn, Alabama: On or about April 2, 2013 and at times prior; the employer exposed his employees to fall hazards of 12.2 feet to the ground below in that he failed to ensure employees installing a roof had fall protection in place. THE GARCIA FRAMING WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVELANT STANDARD 29 CFR 1926.501(B)13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 762741, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON JANUARY 3, 2013, WITH RESPECT TO A WORKPLACE LOCATED AT 1695 ALEX AVENUE AUBURN, ALABAMA.
