29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (Refer to 1926.602 (d))    a) Jobsite located at 5 Chandler Street Lot #14, Richmond Hill, GA - On or about, and at times prior to April 2, 2013, the employer did not ensure employees who were allowed to operate a Pettibone Rough Terrain forklift Model 636, were trained and capable of identifying specific operating limitations such as, but not limited to, determining if equipment was allowed to lift personnel.  Employees were lifting personnel with a Pettibone forklift Model 636, that was not authorized by the manufacturer to lift personnel, which exposed employees to fall hazards up to 25 feet. The unapproved platform was not designed and used in accordance with the ASME B56.6, section 8.24.1, exposing employees to fall hazards up to 25 feet.       b)  Jobsite located at 5 Chandler Street Lot #14, Richmond Hill, GA - On or about, and at times prior to April 2, 2013, employees performing steel erection activity were observed working from an unapproved elevated 3-foot X 16-foot metal platform that was not designed and approved by a qualified person, in that the platform extended more than 10-inches past the wheel base.
