29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.    a) Jobsite, Fourth floor - Employees receiving supplies through the wall opening were exposed to a fall hazard of approximately thirty (30) feet without the use of fall protection.  Observed on or about April 3, 2013.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames,  or uprights did not bear on base plates, mud sills or other adequate firm foundation:      a) First floor elevator shaft - Employees laying cinder blocks were exposed to a collapse hazard as the tubular welded frame scaffold did not bear on base plates or a firm foundation.  The tubular welded frame scaffold was erected on two stacked cinder blocks turned on their side.  Observed on or about 04/03/2013.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports as follows:    a) First floor elevator shaft - The working level of tubular welded frame scaffold was not fully decked between the front and rear posts of the scaffold.  Employees installing cinder blocks were exposed to an opening of approximately 40 inches by 40 inches due to the lack of adequate planking.  Observed on or about 04/03/2013.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access.    a) First floor elevator shaft - The portable ladder used to access the working level of the tubular welded frame scaffold did not extend at least three feet above the working surface.
