29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    a) County Concrete, 64 Glenwood Place, East Orange, NJ 07017    A noise monitoring program was not developed for employees cleaning the inside of the concrete mixing apparatus with mini-jackhammers were exposed to continuous noise at 582.2%, 488.2%, and 302.8% of the permissible exposure limit (PEL) eight hour time-weighted average sound level of 90 dBA which are 5.8, 4.9, and 3.0 times the allowable exposure limit respectively.  The action level is 85 dBA.  The equivalent sound levels of the measured doses are 102.7 dBA, 101.4 dBA, and 98.0, dBA respectively.  Sampling was performed for 299, 297, and 282 minutes on 6/8/2013, with the unsampled portion of time considered to represent zero for the exposure calculation.             Violation occurred on or about 6/8/2013.
