29 CFR 1910.119(d)(3)(i)(E): Process safety information pertaining to the equipment in the process did not include the ventilation system design.      The employer does not ensure that process safety information includes the ventilation system design.       This violation occurred on or about April 26, 2013 and times prior thereto in ammonia cylinder filling warehouse where the employer failed to ensure that the process safety information included the design and design basis for the room ventilation.  This condition exposed employees to fire, explosion, and inhalation hazards.      Pursuant to 29 C.F.R. 1903.19, within (10) calendar days of the abatement date the employer must submit documentation showing that it is in compliance with the standard, including the description of the steps that it is taking to ensure that the process safety information includes the ventilation system design.

The employer does not ensure that process safety information pertaining to equipment included the design codes and standards utilized.       This violation occurred on or about April 26, 2013 and times prior thereto in ammonia cylinder filling warehouse where the employer failed to ensure that the process safety information included the design codes and standards utilized for the design of the room ventilation system.  This condition exposed employees to fire, explosion, and inhalation hazards.      Pursuant to 29 C.F.R. 1903.19, within (10) calendar days of the abatement date the employer must submit documentation showing that it is in compliance with the standard, including the description of the steps that it is taking to ensure that process safety information pertaining to equipment included the design codes and standards utilized.

The employer does not ensure written procedures are established and implemented to maintain the on-going mechanical integrity of process equipment.      The violation occurred on or about April 26, 2013 and times prior thereto in the Ammonia Storage and Cylinder filling and Amine Cylinder filling areas where the employer failed to ensure written procedures were established and implemented for the annual visual inspection of vessels and piping. This condition exposed employees to fire and explosion hazards.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date the employer must submit documentation showing it is in compliance with the standard, including describing the steps it is taking to ensure written procedures are established and implemented to maintain the on-going mechanical integrity of process equipment.

29 CFR 1910.119(j)(4)(ii):  Inspections and testing procedures performed on process equipment to maintain its mechanical integrity, did not follow recognized and generally accepted good engineering practices.    The employer does not ensure inspections and tests are performed to maintain the on-going mechanical integrity of process equipment followed recognized and generally accepted good engineering practices (RAGAGEP).    The violation occurred on or about April 26, 2013 and times prior thereto in the Anhydrous Ammonia Storage and Cylinder Filling Areas where the employer failed to ensure inspections and tests were performed on ammonia vessels and piping by a competent person in accordance with RAGAGEP such as CGA G-2 (1995). Identified vessels include but not limited to T-1, T-2, T-4, T-5, and T-6. This condition exposed employees to fire, explosion, and inhalation hazards.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date the employer must submit documentation showing it is in compliance with the standard, including describing the steps it is taking to ensure inspections and tests are performed to maintain the on-going mechanical integrity of process equipment followed recognized and generally accepted good engineering practices (RAGAGEP).
