29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 926.502: This violation most recently occurred on April 04, 2013, at a workplace located at 8893 Southwestern Boulevard, Dallas, TX 75206; where one (1) employee was observed working from the buildings roof, was not protected from falling an approximate twenty (20) feet to the ground level below. ABEL BENITEZ WAS PRECVIOUSLY CITED FOR A VIOLATION OF 29 CFR 1926.501(b)(13) OR ITS EQUIVALENT, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 316095223, CITATION NUMBER 01, ITEM 01, AND WAS AFFIRMED AS FINAL ORDER ON MAY 10, 2012, WITH RESPECT TO A WORKPLACE LOCATED AT 1954 SHEOF DRIVE, IRVING, TX 75061.
