29 CFR 1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) shall be restrained from tipping by guying, tying, bracing, or equivalent means, as follows: a. On or about April 09, 2013 - at the above addressed jobsite, employees were performing brick laying operations from a tubular welded frame scaffold with a height to base width ratio greater than four to one (>4:1) that was not restrained from tipping, thereby exposing employees to falls.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access. a. On or about April 09, 2013 - at the above addressed jobsite, employees conducting masonry operations from a tubular welded frame scaffold approximately fourteen (14) feet above the ground were not provided with an access ladder, thereby exposing the employees to a fall hazard. ZILY CONSTRUCTION INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.451(e)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313939100, CITATION NUMBER 1, ITEM NUMBER 3 AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 1, 2010 WITH RESPECT TO A WORKPLACE LOCATED AT 12151 73RD AVE., PALOS HEIGHTS, IL 60463.

Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews. b. On or about April 09, 2013 at the above addressed jobsite, employees performing brick laying operations from a tubular welded frame scaffold lookout bracket, approximately fourteen (14) feet above the ground, were exposed to injuries from falls due to lack of side rails.
