29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c): a) North excavation at approximately 2330 N. Lawndale Ave: Employees working in an excavation up to approximately 6.6 feet in depth were exposed to cave-in hazards. Joel Kennedy Constructing Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA violation number 313238305, citation 1, item 3, issued on June 18, 2009, and became final order on or about July 30, 2009, with respect to a workplace located at Rohlwing Rd. & Carnegie St., Rolling Meadows, IL 60008. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.652(c)(2)(i): 29 CFR 1926.652(c)(2)(i): Design of support systems, shield systems, or other protective systems that are drawn from manufacturer's tabulated data were not in accordance with all specifications, recommendations, and limitations issued or made by the manufacturer: South excavation at approximately 2220 N. Lawndale Ave Speed Shore hydraulic shoring being used to protect an excavation was not being used in accordance with the manufacturers recommendations and limitations outlined in the tabulated data: a) The center line of the bottom hydraulic cylinder was not a maximum of 4 feet above the bottom of the excavation. b) There was not a minimum of 3 consecutive shores in a row, at the horizontal spacing indicated, to form a shoring system. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
