29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge 6 feet or more above a lower level was not protected from falling by the use of a guardrail system, safety net system, or personal fall arrest system: On or about April 8, 2013, at the worksite located at 2609 Unit One South Main Street in Searcy, Arkansas, employees working on an approximately 2:12 pitched metal roof engaged in work activities such as but not limited to gutter installation were not protected from flaling to lower level. Employees were exposed to an approiximately 11 ft. fall from elevation.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On or about April 8, 2013, at the worksite located at 2609 Unit One South Main Street in Searcy, Arkansas, the Werner 24 ft. extension ladder used to access and descend from the roof extended approximately 18" above the roof landing surface. This condition exposed employees to the hazard of falls from elevations.
