29 CFR 1926.602(a)(9)(ii): Earth moving or compacting equipment which had an obstructed view to the rear was operated in reverse gear; such equipment did not have in operation a reverse signal alarm distinguishable from the surrounding noise level or did an assistant signal that it was safe to operate in reverse gear: (a) Ensign United States Drilling, Inc. at Bydalek 28N-20HZ, Hudson, CO 80642: On and before April 3, 2013 the employer did not ensure that the signal alarm on the Volvo front-end loader was operational when the equipment was used in reverse gear. The front-end loader is used to move soil and mud onsite. Employee signals were not used as the other method available. This condition exposed employees to struck-by hazards.
