29 CFR 1910.37(a)(4): Safeguard(s) designed to protect employees during an emergency (e.g., sprinkler systems, alarm systems, fire doors, exit lighting), were not in proper working order at all times:  a) Warehouse, Bay 2, Exit Door - Noted on or about  4/19/13 and at times prior thereto, the exit door stuck to the door frame and could not be opened without excessive force, thereby preventing safe egress.

29 CFR 1910.36(d)(3): An exit route door may be locked from the inside only in mental, penal, or correctional facilities and then only if supervisory personnel are continuously on duty and the employer has a plan to remove occupants from the facility during an emergency.   a)  Chill Room Warehouse,  Bays 2-5, exit doors - Noted on or about 4/19/13 and at times prior thereto, four exit doors were locked for security reasons.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2):  a) Warehouses - Noted on 4/19/13 and at times prior thereto, the employer did not prepare a workplace hazard assessment for employees working in cold or freezing environments and that operate powered industrial trucks that require the use of personal protective equipment (PPE).  The following elements shall be addressed in the workplace hazard assessment:        1.  Select and have each affected employee use the types of PPE that will protect them from the hazards identified in the hazard assessment;    2.  Communicate the selection decisions to each affected employee and;  3.  Select PPE that properly fits each affected employee.          *ABATEMENT NOTE:  The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.
