29 CFR 1926.20(b)(2): The employer did not initiate and maintain a program of frequent and regular inspections made by competent persons at the jobsite: a) Floor hole covers were not inspected and maintained; some "Floor Hole" markings were not visible and some covers were not secured properly. Location: kitchen exhaust shaft floor hole covers. b) Two metal doors in the exit stairway had sharp rusted metal exposed near the doorknobs. Construction personnel were exposed to laceration hand injury when using the exit stairways. Location: 404 Park Ave S, New York, N.Y; at the 6th floor of the construction jobsite. On or about 4/5/2013 NOTE: BECAUSE THE EMPLOYER CORRECTED THIS ITEM DURING THE INSPECTION THE EMPLOYER IS NOT REQUIRED TO SUBMIT ABATEMENT CERTIFICATION NOR DOCUMENTATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.502(i)(3): All floor hole covers were not secured when installed so as to prevent accidental displacement by wind, equipment, or employees: a) At the construction site: Floor hole covers were not secured on floors 4, 5, 6 of the kitchen exhaust shaft. There were cleats on the underside of the covers to keep them in place but the covers were not nailed (shot-nailed) down. A floor hole cover on the 6th floor shifted out of place, exposing employees to fall hazard. Location: 404 Park Ave S, New York, N.Y; at the 6th floor of the construction jobsite. On or about 4/5/2013 NOTE: BECAUSE THE EMPLOYER CORRECTED THIS ITEM DURING THE INSPECTION THE EMPLOYER IS NOT REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

The covers originally were marked in orange spray paint but markings were no longer visible due to construction activity/ dust. Employees were exposed to floor hole hazard. Location: 404 Park Ave S, New York, N.Y; at the 6th floor of the construction jobsite.
