OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazard by connecting to lifting rings of a Miller Edge Fall Protection System:      a) 1000 Avenue of Port Imperial, 4th Floor, Weehawken, NJ.      Employee observed using a lifting ring on the Miller Edge Fall Protection System as anchorage point for a fall protection system, thereby exposing the employee to an inside fall hazard of 10 foot to the floor below.                               Violation observed on or about 05/13/2013.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   a)  1000 Avenue of Port Imperial, Weehawken, NJ.   Employees were observed walking/working at the North East edge of the 5th floor without any means of fall protection, thereby exposing them to a fall hazard of approximately 50 feet to the ground.                                  Violation observed on or about 04/19/2013.   b) 1000 Avenue of Port Imperial, 4th floor South side, Weehawken, NJ.   Employees were observed walking/working on the South side of the 4th floor without any means of fall protection being used, thereby exposing them to a fall hazard of approximately 30 feet to the balcony below.                                  Violation observed on or about 04/19/2013.   c) 1000 Avenue of Port Imperial, 5th floor South side, Weehawken, NJ   Employees were observed working at the edge of installing guardrail a system without being connected, thereby exposing them to a fall hazard of approximately 40 feet to the balcony below.                                  Violation observed on or about 05/01/2013.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement:   a) 1000 Avenue of Port Imperial, Weehawken, NJ.   Employee was observed walking/stepping over and around unprotected reinforcing steel, thereby exposing employee to possible impalement of unprotected reinforcing steel.
