29 CFR 1910.1030(c)(1)(iv): The Exposure Control Plan was not reviewed and updated when necessary to reflect new or modified tasks and procedures which affect occupational exposure and to reflect new or revised employee positions with occupational exposure: a) The company had not reviewed and updated the exposure control plan, from the purchase of "Midwest Dialysis Center, Inc." in January 2013, to reflect the new ownership policies and procedures such as the use of new safey needles and devices to prevent sharps injuries. Fresenius was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1030(c)(1)(iv) which was contained in OSHA inspection number 314228255, citation number 1, item number 1b, issued on September 14, 2010, which was affirmed as a final order on September 29, 2010 with respect to a workplace located at 1740 S. State Road Philadelphia, PA 19082.

29 CFR 1910.1030(c)(1)(v): The employer, who is required to establish an Exposure Control Plan, did not solicit input from non-managerial employees responsible for direct patient care who are potentially exposed to injuries from contaminated sharps in the identification, evaluation and selection of effective engineering and work practice controls and did not document the solicitation in the Exposure Control plan: a) The employer did not solicit input from non-managerial employees with direct patient care regarding the selection of engineering and work practice controls implemented in January 2013 by "Frecenius" with documentation in the exposure control program. Fresenius was previously cited for a violation of this occupational safety and health standard 29 CFR 1910.1030(c)(1)(v) which was contained in OSHA inspection number 314228255, citation number 1, item 1a, issued on September 14, 2010, which was affirmed as a final order on September 29, 2010 with respect to a workplace located at 1740 S. State Road Philadelphia, PA 19082.

29 CFR 1910.1030(g)(2)(v): Employees were not provided additional training when changes such as modification of tasks or procedures or institution of new tasks or procedures affected the employee's occupational exposure: a) Changes and modifications to the engineering controls regarding employee exposure to blood and body fluids were made in January 2013, when "Midwest Dialysis" was purchased by "Fresenius", including but not limited to the use of safer sharps. Employees with direct patient care were not iprovided training on the changes made that affect exposure to blood borne pathogens until the end of March and April 2013.
