29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:    a) On or about 04/22/13, on construction site at the Cave of the Winds Concession Stand located on Goat Island, Niagara Falls State Park, Niagara falls, NY:   One Employee engaged in roofing work was not trained to recognize potential hazards on this type of jobsite including but not limited to falls from roofs,ladders, scaffolds, and other surfaces such as but not limited to coolers. He also was not trained about the specific fall protection regulations to be followed in order to minimize these hazards.       ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:     a) On or about 04/22/13, on the shingled portion of the roof at the Cave of the Winds Concession Stand located on Goat Island, Niagara Falls State Park, Niagara falls, NY: Employees engaged in roofing work were exposed to a fall of approx. 16 ft. because no fall protection system was utilized. The roof pitch was estimated to be approx. 6 in 12. All of the employees were wearing full body harnesses, but none were not tied off to an anchorage point.   NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system:    a) On or about 04/22/13, on the flat part of the roof at the Cave of the Winds Concession Stand located on Goat Island, Niagara Falls State Park, Niagara falls, NY: An employee engaged in roofing work was exposed to a fall of approx. 13 ft. because no adequate fall protection system was utilized. The employee was wearing a full body harness, but he was not tied off to an anchorage point.    NO ABATEMENT CERTIFICATION REQUIRED
