29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about 06/23/14, on residential roof construction site 18 Stephenson Ave. , West Seneca , NY: Two employees engaged in construction work were not trained to recognize potential hazards on this type of jobsite including but not limited to falls from roofs, ladders, skylights, stairs & scaffolds, electrical hazards, unguarded tools/machines, fire hazards, and the need for personal protective equipment to protect them from various hazards. They also were not trained in the applicable OSHA regulations to control or eliminate these hazards. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: undefined : a) On or about 06/23/14, on the east (right) side of the house at 18 Stephenson Ave. , West Seneca , NY: Nine employees were exposed to a fall of approx. 20 ft. when an extension ladder was used to access the Aluminum Pik on a ladder jack scaffold. The siderails of the ladder only extended approx. 9 inches above the Pik.. NO ABATEMENT CERTIFICATION REQUIRED

WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 901830, CITATION NO. 1, ITEM NO. 2 a, AND WAS AFFIRMED AS A FINAL ORDER ISSUED ON 05/30/2013, WITH RESPECT TO A WORKPLACE LOCATED AT NIAGARA FALLS STATE PARK, GOAT ISLAND, NIAGARA FALLS, NY 14303. 29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) On or about 06/23/14, on the east (right) side of the roof of house at 18 Stephenson Ave. , West Seneca , NY: Nine employees engaged in roofing tear-off work were exposed to a fall of approx. 23 foot. The roof pitch was approx. 12 in 12. There was a slide guard installed along the eve of the roof, but no other fall protection system was utilized. NO ABATEMENT CERTIFICATION REQUIRED
