OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the employee who rode the bucket of the hydraulic excavator into a trench was not protected from fall, struck by and caught in between hazards. (a) Edward St Springfield, MA: On or about April 23, 2013, an employee was observed riding in the bucket of the Cat 320C excavator down into the protective system being installed in this trench exposing the employee to fall, struck by and caught in between hazards created by this operation. Among other methods, one acceptable and feasible abatement method to correct this hazard would be to follow the requirements outlined in the Caterpillar Operation and Maintenance Manual SEBU7342-08 for the 320C excavator and not allow employees to occupy the excavator bucket: Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19(d)(1).
