29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: Note:  Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. a.  Warehouse, batch mixing platform - Noted on or about 4/23/13 and at times prior thereto, the batch mixing platform, measuring 7 feet, 3 inches to ground level, did not have standard guardrails in place; a mid-rail and toeboard was not provided.  Employees can pass underneath the platform and a forklift is operated in front of the platform.

29 CFR 1910.26(a)(1)(iii): The spacing of rungs or steps was not on 12-inch (30.48 cm) centers: a.  Warehouse, batch mixing platform ladder - Noted on or about 4/23/13 and at times prior thereto, the rise of the top rung of the metal ladder measured 21 inches to the working platform.  The distance from the mixing platform to ground measured 7 feet, 3 inches.

Warehouse - Noted on or about 4/23/13 and at times prior thereto, the written Hazard Communication Program did not describe or explain Section (f), the labeling system used in the work place.  Employees use a variety of raw ingredients to mix batches of a concrete additive that contains Triethanolamine 85%, a mutagen that can be absorbed via skin contact and inhalation to cause liver and kidney damage as well as other physical hazards.

29 CFR 1910.1200(f)(5): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein:  a.  Warehouse, batch tanks -  Noted on or about 4/23/13 and at times prior thereto, tanks containing concrete additives (3% Triethanolamine, 69% lignan, 5% white sugar, and 23% water) were not identified by batch ticket, process sheets, placards or other such written materials that at least convey the contents and the physical and/or health hazards of the mixture.  Employees pump liquids and manually pour powders into the batch tanks and observe the mixing from the work platform before dispensing into shipping barrels.  Triethanolamine is a mutagen that can be absorbed through the skin contact and inhalation.
