29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about April 24, 2013, an employee cutting decking material on the ground was not protected by a protective helmet while other employees were performing decking installation at higher levels. The employee was exposed to being struck by objects such as tools and materials.   Alvaro Lozano was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.100(a), which was contained in OSHA inspection number 314178682, citation number 1, item number 1and was affirmed as a final order on September 14, 2010, with respect to a workplace located at 2231 Hwy 80 East, Mesquite, TX 75150.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.   On or about April 24, 2013, employees performing cutting and decking installation working using circular saws and air naillers were not provided eye and face protection. Employees were exposed to eye and face injuries.   Alvaro Lozano was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.102(a)(1), which was contained in OSHA inspection number 312124175, citation number 1, item number 2, and was affirmed as a final order on August 12, 2009 with respect to a workplace located at 1518 Havenrock Drive, Forney, TX 75126.

On or about April 24, 2013, an employee performing decking installation on a new residential construction home was exposed to fall hazards of approximately 9 feet to the ground below.  Alvaro Lozano was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.501(b)(13), which was contained in OSHA inspection number 312124175, citation number 1, item number 3 and was affirmed as a final order on August 12, 2009 with respect to a workplace located at 1518 Havenrock Drive, Forney, TX 75126.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   On or about April 24, 2013, employees performing decking installation were using a ladder that did not extend three feet above the landing to access and egress the roof, exposing the employees to a fall hazard of up to nine feet to the ground below.
