29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a. On or about 04/18/13, at the mechanics shop area, at Bates Trucking and Trash Removal, Inc. St. Croix, VI. The employer did not implement their written hazard communication program to ensure material safety data sheets availability for Linde compressed gases (oxygen and acetylene) and diesel fuel; and labeling of portable containers (hand sprayer and plastic bottles) of hazardous products such as Formula 88 degreaser (ethylene glycol monobutyl ether) when used and/or handled by employees during forklift and trucks maintenance operations. NOTE: Certification of abatement must be submitted for this citation item (labeling of portable containers condition only) as required by 29 CFR 1903.19(c).
