29 CFR 1926.404(f)(5)(i): For a grounded system, a grounding electrode conductor was not used to connect both the equipment grounding conductor and the grounded circuit conductor to the grounding electrode: (a) Huntley Ditch Project: On or about April 23, 2013, and at times prior, employees were exposed to electric shock in that the employer utilized a 25kva Whisperwatt Generator without grounding cable and grounding rod.

29 CFR 1926.800(j)(1)(iii)(A): The atmosphere in all underground work areas was not tested quantitatively for carbon monoxide, nitrogen dioxide, hydrogen sulfide, and other toxic gases, dusts, vapors, mists, and fumes as often as necessary to ensure that the permissible exposure limits prescribed in 1926.55 are not exceeded: (a) Huntley Ditch Project: On or about April 23, 2013, and at times prior, employees were exposed to acute illness, impairment of ability to self-rescue, and/or death from atmospheres such as but not limited to; oxygen deficient atmospheres and carbon monoxide due to air monitoring not being conducted.
